How long do I have to decide before filing a personal injury claim?
Massachusetts law states that any person filing a personal injury claim must do so within a specific time frame:

  • Personal Injury - within three years of the date of the injury

  • Medical Malpractice – within three years of the date of injury or discovery

  • Motor Vehicle Hit & Run – within six months after the injured person learns the identity of the negligent driver

  • Products Liability – within three years after the plaintiff suffers the injury

  • Minor – special circumstances arise in Massachusetts for minors. A minor’s statute of limitations begins on their 18th birthday.
